TrainLinc Terms of Service

1. Acceptance of these Terms
These Terms of Service (“Terms”) are an agreement between you and Orbiit Services Inc., a Georgia corporation located at 429 Canton Road, Cumming, GA 30040, the operator of TrainLinc (“TrainLinc,” “we,” “us,” or “our”). By accessing or using the TrainLinc website, coursework, or messaging services (together, the “Service”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. The Service
TrainLinc delivers online training coursework — such as firefighter certification preparation — to students enrolled through a sponsoring organization (for example, a fire department). The Service delivers lessons through the web and, for students who opt in, by text message links to their mobile phone.
3. Eligibility and accounts
The Service is intended for adults enrolled through a sponsoring organization. You are responsible for the accuracy of the contact information you provide and for keeping your sign-in access secure. Sign-in links sent to you by text or email are personal to you: do not share them, and tell us promptly at support@trainlinc.com if you believe your account has been accessed without authorization. Coursework must be completed by the enrolled student personally — completing training on someone else’s behalf is prohibited and may be reported to the sponsoring organization and certifying authority.
4. Text messaging terms
By opting in to or using the TrainLinc text message service, you accept these text messaging terms.
Program description: TrainLinc sends training-related text messages — secure lesson links, progress reminders, enrollment opt-in confirmations, and HELP/STOP responses — to students enrolled through their sponsoring organization who have consented to receive them.
Consent: By providing your mobile number and opting in at enrollment, you consent to receive these text messages and to the use of an electronic record of your agreement. Consent to receive text messages is not a condition of any purchase.
Cost and frequency: We do not charge for these messages, but message and data rates may apply depending on your wireless plan. Message frequency varies.
Opting out: Reply STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE to any message to stop receiving texts. We may send one final message confirming your opt-out. Reply START to resume.

Privacy: Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.
Carriers: Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your carrier and network availability.
5. Training content, certification, and assumption of risk
Coursework supplements — it does not replace — hands-on training. TrainLinc coursework is instructional material. It is not a substitute for live, in-person instruction, practical skills evaluation, or the supervision, protocols, and standard operating procedures of your sponsoring organization.
No certification guarantee. Completing coursework on TrainLinc does not by itself confer any license or certification. Certification decisions rest solely with the applicable certifying authority and your sponsoring organization, and may require additional requirements such as practical evaluation.
Physical skills and assumption of risk. Some coursework describes physical techniques (for example, CPR or water survival skills). Practice or perform physical techniques only under qualified in-person supervision and in accordance with your organization’s protocols. To the fullest extent permitted by law, you assume all risk arising from your practice or performance of physical activities described in the coursework, and you release TrainLinc and Orbiit Services Inc from liability for injuries arising from such practice or performance undertaken outside of qualified supervision.
Not medical advice. Course content, including CPR and first-aid material, is provided for training purposes and is not medical advice. In an emergency, call 911.
6. Acceptable use
You agree not to misuse the Service, including by attempting to access other users’ or organizations’ data, interfering with the operation or security of the Service, scraping or redistributing course content, or using the Service in violation of applicable law.
7. Intellectual property
The Service and its course content are owned by or licensed to Orbiit Services Inc and are protected by intellectual-property laws. Third-party curricula and standards referenced in coursework (for example, IFSTA materials) remain the property of their respective owners. We grant you a limited, non-exclusive, non-transferable license to access the coursework for your own training while enrolled. No other rights are granted.
8. Privacy
Our collection and use of personal information is described in the TrainLinc Privacy Policy.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT MESSAGES WILL BE DELIVERED WITHOUT DELAY.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ORBIIT SERVICES INC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATING TO THE SERVICE, AND OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE AMOUNT PAID FOR YOUR ENROLLMENT IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED DOLLARS (US $100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
11. Indemnification
You agree to indemnify and hold harmless Orbiit Services Inc from claims arising out of your violation of these Terms or misuse of the Service, to the extent permitted by law.
12. Termination
Your sponsoring organization controls your enrollment, and we may suspend or terminate access to the Service for violation of these Terms or to protect the Service and its users. Sections that by their nature should survive termination (including Sections 5, 7, and 9–11) survive.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a new effective date, and for material changes we will provide additional notice through the Service. Continued use of the Service after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the State of Georgia and the laws of the United States, without regard to conflict-of-laws principles.
